These Terms of Use (“Terms”) are an agreement between you and the operator of WestchesterBarbers.com (the “Site”) (“we,” “us” or “our”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
Paid “Featured” listings are also governed by our Featured Listing Terms. How we handle personal information is described in our Privacy Policy.
1. What the Site is
The Site is an independent online directory of barbershops, hair salons and other places to get a haircut in Westchester County, New York. We are not affiliated with, and do not act on behalf of, any business listed on the Site. Listings are compiled from publicly available information and from information submitted by business owners and visitors.
2. Listings are for general information only
We try to keep listings accurate, but we do not guarantee that any listing — including names, addresses, phone numbers, hours, prices, websites or descriptions — is complete, current or correct. Businesses open, close, move and change their offerings. Always confirm details directly with the business before relying on them.
We do not inspect, license or endorse any business listed on the Site, and we do not verify any business's licenses, qualifications, hygiene or sanitation practices, pricing or quality of work. A listing — including a Featured listing — is not a recommendation.
3. Paid placements
Some listings are paid advertising. They are labeled “Featured” and appear ahead of other listings in the same town. Payment affects placement and the extra details a listing can show; it does not mean we have reviewed or endorse the business. All other listings appear free of charge.
4. Information you submit
When you submit information to us — for example by suggesting a shop, claiming a listing or sending a correction — you confirm that it is accurate to the best of your knowledge and that you have the right to share it. You grant us a non-exclusive, worldwide, royalty-free, perpetual and irrevocable license to use, reproduce, edit, format, publish and display it in connection with the Site and our services. We may decline, edit or remove any submission at our discretion. Please do not submit anyone else's personal information without their permission.
5. Corrections and removal requests
If you own or manage a listed business and something is wrong, or you would like your listing removed, use our westchesterbarbers.com/contact page. We may ask you to verify that you are authorized to act for the business. We correct verified errors promptly and consider every removal request from a business's owner, but we are not obligated to remove accurate, publicly available factual information.
6. Acceptable use
You agree not to:
- copy, scrape, harvest or bulk-download listings or other content from the Site, or use it to build a competing directory or database, without our written permission;
- use bots or other automated means that place an unreasonable load on the Site or interfere with its operation;
- submit false, misleading, infringing, defamatory or unlawful content, or impersonate any person or business;
- use the Site to send spam or unsolicited messages; or
- attempt to gain unauthorized access to the Site, its systems or its data.
7. Intellectual property
The Site's design, text, graphics and the selection and arrangement of listings are owned by us or our licensors and are protected by law. You may view and share individual pages for personal, non-commercial use. Business names, logos and trademarks shown on the Site belong to their respective owners, and their appearance on the Site does not imply any affiliation with or endorsement by those owners.
8. Third-party links and services
The Site links to third-party websites and services such as maps, booking services and businesses' own websites. We do not control them and are not responsible for their content, availability, practices or policies. Your use of them is at your own risk and subject to their terms.
9. Disclaimers
THE SITE AND ALL LISTINGS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE ARE NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, SERVICES OR PRODUCTS OF ANY BUSINESS LISTED ON THE SITE, AND ANY DEALINGS YOU HAVE WITH A LISTED BUSINESS ARE SOLELY BETWEEN YOU AND THAT BUSINESS.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR ANY LISTED BUSINESS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). LIABILITY RELATING TO A FEATURED LISTING IS GOVERNED BY THE FEATURED LISTING TERMS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
11. Indemnity
If you submit content to the Site or use it in violation of these Terms, you agree to defend, indemnify and hold us harmless from any claims, losses and expenses (including reasonable attorneys' fees) arising from that content or violation.
12. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Westchester County, New York, and you and we consent to their jurisdiction — except that either of us may bring an individual claim in small claims court if it qualifies.
13. Changes
We may update these Terms from time to time. The “Last updated” date above shows when they last changed. Changes apply from the date they are posted; if you keep using the Site after that, you accept the updated Terms. Changes that affect paying Featured customers are handled as described in the Featured Listing Terms.
14. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a sale or transfer of the Site.
